Civil Action No. 09-38-ART ORDER *** *** *** *** Plaintiffs filed the complaint in this case under the Digital Millennium Copyright Act and the Communications Act on March 20, 2009. R.1; 17 U.S.C. 1201; 47 U.S.C. 605. On March 25, 2009, the Court granted Plaintiffs a temporary restraining order against Defendants. R. 12. Plaintiffs were required to file a $100,000 security bond with the Court. R. 15. Plaintiffs and Defendants entered into a consent decree on November 19, 2009. R. 51. On December 22, 2009, Plaintiffs and Defendants filed a joint motion to approve the consent decree agreed to by the parties in this case. R. 51. The decree requires Defendants to make a settlement payment of $2,500,000 to Plaintiffs. Id. at 5. Defendants are also permanently enjoined from knowingly participating in any of the activities as listed in the consent decree. Id at 3-4. Should Defendants ever breach any part of the permanent injunction, they will be liable to Plaintiffs for $110,000 for each violation. Id. at 4. Accordingly, it is ORDERED as follows: 1 The motion to approve the consent decree, R. 51, is GRANTED. 2 The effective date of the consent decree shall be the date of this order. 3 The court clerk shall RELEASE Plaintiffs' $100,000 security bond, R. 15. 4 This case is DISMISSED as settled and shall be STRICKEN from the Court's active docket.
