The Defendants illegally manufactured, modified, sold and/or distributed "pirate" descrambling equipment to sub-distributors, purchasers and other end-users of such equipment, or assisted in same, with the specific intent and knowledge that such equipment would be used to decode the scrambled programming services of the Plaintiff by persons not paying for those services and not authorized to receive the same.

Throughout 2004, Plaintiff made additional attempts to locate and
serve Defendant Kwak. These attempts were uniformly unsuccessful. Pursuant to
an investigation in 2006, Plaintiff attempted to located Defendant Kwak by tracing
the name Jung Kwak to an area in California to which his cellular telephone had
been linked. This search located over 30 Jung Kwaks in the Los Angeles area
alone.


On or about February 11, 2008, Plaintiff's counsel learned that a Jung
Kwak was a defendant in a lawsuit pending in the United States District Court for
the Southern District of California for the alleged sale of pirate satellite equipment
(the "Second California case").

I don't see any point in repeating the allegations which we we have seen over 10 days ago. Almost all the major FTA manufacturers have or have had case brought against them by Dish and or Bell.
In the meantime the industry has expanded and will continue to do so.

There is the collective will of millions to watch Free TV; hence, Free To Air - FTA or Free From Air - FFA or Free In Air - FIA. It's all the same.

This lawsuit was originally filed on August 8, 2003, alleging that Defendant Jung Kwak's business (Matinee TV) was involved in the sale of illegal cable descrambler boxes (also known as "black boxes") in clear violation of the Cable Communications Act, 47 U.S.C. 553. See D.E. 1.1 Since the filing of the Complaint, and later Amended Complaint, Comcast has diligently attempted to obtain service of process on Defendant Jung Kwak, including numerous attempts with process servers, and numerous skip trace research. It is readily apparent that Defendant Jung Kwak has been going out of his way to conceal his true residential address, and to evade service of process. Finally, after discovering on or about February 11, 2008, that a Jung Kwak was a Defendant in a federal court lawsuit pending in the USDC for the Southern District of California by Plaintiff EchoStar Satellite, LLC for allegedly selling pirate satellite equipment (a business very similar to selling illegal cable boxes), counsel for Comcast immediately sought to obtain service of the Nevada suit on this Jung Kwak.

I have been with computer software since the IBM Mainframe computer was housed in a large airconditioned room and boasted a LARGE 64K memory!!
From that day on till now there has never been one software announcement or a patch or a modifications that was delivered as promised (time-wise).
Most of the manufacturers are very prompt with a new peice of hardware or computer but when it comes to software there is usually a longer delay than anticipated.
N3 software or a penetration of it is no exception to the rule that
NO SOFTWARE GETS DELIVERED ON TIME

All firmware or software is software that gets delivered eventually after an unannounced delay, is always full of bugs, gets modified always and as per Parkinson's law, gets obsolete when it is bug-free.

If you recall Sonicview's last file for N2 was probably bug-free and unshakeable. Therefore it had to be obsoleted!!
That is another axiom about software. When it is becomes easy to copy or emulate the original authors will discard it. Windows XP has entered that stage and after an aborted attempt with Vista, Microsoft is introducing windows 7. All versions of Microsoft Office are now triply emulated and will be discarded by Microsoft, because the product can't be easily sold.

Those announcements and news really make it hard for the norm users and i am one of them. I don't mind waiting but I am upset of all these kinds of news coming from them.

asp: I agree with you when you say, "news really make it hard for the norm users" but the reality of life is what king IBM did in the sixties and seventies and set the rules of software announcement. These tactics of premature announcements eventually were well understood by the hardware users and we also have to somehow come to terms with these tactics.
