FTA File Distribution dangerous?

Bronze Member Username: James_millardPost Number: 90 Registered: Jan-10 | My knowledge about Law and the workings of the Judicial System is very limited, so I decided to consult a neighbor of mine (a retired Judge) about illegal file distribution and its implications. (So I'll do my best to try explain it in LAYMAN'S terms.) First off, of course it's considered an illegal act. But,..... the Judge has to take into account the motifs, circumstances and consequences. Since in the Cyberworld (the web) ID's, Nicks, etc. are so vulnerable to be cloned, stolen or misused, they will normally NOT be considered as incriminatory. IF the person who distributed the files DID NOT generate them, It has to be PROVEN that there was an ASSOCIATION with the one who did for monetary reasons or to harm the affected party. Now, I don't want to name names (NN) but I was told that Mr. No Name is DEFFINITELY off the hook. Mostly if that persons motifs was only for HELPING others or as part of a SOCIAL ACTIVITY. So his personal best advice was : If anyone accuses him ( NN ) of any wrong doing just answer them back..... "Well, then sue me, B!tch!" (  ) |

He is poisting as if Nalin Nyda is posting. Now the person who started this thread calls himself The Voice. He has chosen the Username: James_millard, but he joined in January, 2010. Anybody can look up old records and try a username if it is available and then use it. There are several old memebrs who have actually given up their memebrship of Ecoustics - yes you can do it - and others, usually trouble makers pick up that name and start using it. In this case, The Voice - Bronze Member Username: James_millard Post Number: 90 Registered: Jan-10 seems to be a straightforward person and not a trouble maker. But you can't say that he is the same person James millard and who probably posted as Jmill1948 that you knew 4-5 years ago. |

It is very easy for people to steal old names once they are discarded. In some forums they are removed if inactive for a length of time and in this one it seems peole can just resign any time. Then the username is available. I don't know James Millard and in general, my policy is to see the current status - like your (whiskey's) status to me is nothing more than a newbie, whatever your pedigree or vintage. |

However, sometimes they get tangled in long legal analysis and set bad precedents which are obviously wrong. Doesn't happen often, but it did happen when they decided the DTV case in the Supreme Court of Canada. I look at my collection old tapes, video tapes, DVDs and most of it done using regular hardware bought at big depeartment stores and that is all very legal! But watching TV for personal use using a device manufactured in Korea, software made in Germany and downloaded from a server in Mexico is considered wrong! Ah well. Life goes on. |

(not a very well known fact)... use to post here in the sat TV forum gold member too. He know longer posts here much .. he a visting Admin at another site now. Nalin you knew him well but didn't know his real life job status. Just goes to show you that any kind of person can get away with illegal file distribution. He must know of some loop holes to get away with it in a place like this. |
