Hmm... Interestingly enough, I was threatened tonight in the most unusual way.. Would like some input on what people think.. (I actually plan on talking to a DA, since I have to testify in a criminal case anyways, and have a meeting with her before the case) But just wanted some input before then..

I'm driving down one of the main roads here in Reno, "Virginia Street", where all the casino's are.. Noisy as all hell, even a very small open-air stadium at the end of main strip.

It's about 8pm friday night, so it's crowded as hell, traffic is very slow going etc.. I'm sitting with my stereo off (letting my batteries charge... running off a 105 amp alternator until I get mine back from excessive amperage), and a mustang pulls up next to me, at a red light, bumping (kind of) but you can clearly hear how bad he's clipping his highs and his subs... Sounds like crap. Probably some lanzar/pyle/pyramid 12's in a prefab ported box I'm guessing, with a "BOSS" amp, I'd guess stock 6.5"s LoL. (this is just speculation)

Ok. This is a situation where I'll actually turn up my radio. So I turn it on, to pretty much as loud as it gets (a little over 150 dB on a good day). Neon blue lights up the interior of my car, white neon underbody comes on... Usual happens, pretty much everyone walking by, and the people in cars around me stare.. etc etc.. (lol - damn, I love doing that though when someone has a really bad system that thinks they're "pimping".. Nothing like turnin on some Lords of Acid and having your bass destroy someone listening to N***a F**K this N***A F**K that, I'm white but dont realize it, F**K THE WORLD) (No offense to anyone who's a fan of rap, lol. I'm not racist, just making a point of the type of music he was playin).

Ok, so, I make a left turn, and a cop comes FLYING up on my @$$, I pull over.. To make a long story short, after sitting there for 15 minutes while he waited for backup(??) I was told that if the bass from my car was literally hurting his ears 2 cars behind me, that it was obscene, and if he ever heard my music that loud, he'd personally throw my @$$ in jail for assault on an officer?? I asked why (or actually, verbatim, said "HUH??") and he told me that my stereo was physically causing him harm.

Anyone think that a charge like this would actually stick in court?? I mean I know it kills my ears, and I cant even play in that volume long at all, (at least, and remain in the vehicle) But 2 cars away, there's no way it was hurting his ears... I mean give me a break... It was probably less than 110 dB in his car.. (I'm guessing? never get to hear my system from another vehicles point of view, since I wont let ANYONE drive my car).

So.. if anyone has any idea's of this kind of thing is precedented(sp?) in court, in a criminal trial, please let me know.

Ouch, so it hurt him 2 cars away? That's kinda crazy. He must have the most sensitive ears in the world lol.
But I dunno what to say besides talk to someone who deals with police and all that and ask them what kinda of trouble that is and if he can actually do that. Cause I find it hard to believe that he can do that.

Seth, you have some options.
You can plead guilty to whatever bogus charge the cop will come up with, or take out your subs and amps and have them replaced with a weaker one for now.
You can then take the car and have it db tested from 2 cars down. Have it on record. Talk to a DA afterwards. Make sure you cover all the bases.
Then you go to court and fight. I am positive the cop has no PHYSICAL evidence to support his claims. It doesn't take a genius in court to point out that you need more than, "my ears were hurting 2 cars away" to win.
Since there were no other cops near nor a doctor to support his claims, you really can't lose. Well maybe you'll get a noise ticket.
Other than that, you should have no criminal record.
If not, who knows what they'll do to you. Before they force you to take your car and have it tested, you beat them at the game.

I think it was an idle threat, really.. I'm not too concerned, but boy was I pissed... I'll admit, 150dB is stupid loud.. (louder than a lot of people on these boards think.. talking termlab dB drag rules) but I think the officer must have just been having a sh!tty day.. I would put up the biggest fight, and make sure I attracted all the attention to the case possible if I were to ever get charged with something so heinous.

1st offence: warning
2nd: 150$ ticket plus court fees 100$
3rd: all your audio equipment is up for police auction! plus court fees!

If the system is missing they cant do shhhh!

You should of just told him to turn off his dang siren cause it was hurting your ears with the high pitched noise. And then as your leaving turn up your stereo with the song fu*k the police.lol NO he would of probably dragged you out of your car and beat you.lol

I let my friend drive my Jeep one night (I don't know why) and he was "showing off" my system at a stop light. Now, I can hit 150db on those meters from www.splmeter.com all day long. I havn't gotten it on the TL yet, gonna do some more work first.

Anywho, I was two cars down, in his 2001 Mercury Cougar, and all his mirrors and windows were vibrating, and you could almost feel it in the seat. But my ears didn't hurt.... So I call bullsh1t on the officer.

You have a right to turn it up, but honestly, I turn it down when in slow traffic/at the light. It's just respect.

id say he was a grumpy old cop who wanted someone to pick on. He has no case, i mean seriously..music turned up? can he charge the DJ at a bar with assult when he has 10,000 watts with towers and monitors blasting 2 feet away from you? no, ovcorse not. Tell them you were just showing off to a friend and it never goes that loud especially around houses or residentail areas (make the judge happy). It was his choice to live in that city, he better get used to a little noise. You may have lost if you were in a 'quiet zone' but judging from where you were, this was definatley not a quiet zone. I cant see what the charge would be. If it physically 'caused him pain' then surley you would be in the hospital with your ears bleeding, right? well your not, in fact you were 'in the music' and you are fine.

i love calling cops' bluff. even when they actually attempt to go through with it in court, my lawyer eats them up every time. it's pretty personal with me. but that was in my younger days. i have a family to think about now, so i usually have to smile at the idiot pig and play the "ok" role. otherwise i'd have called his bluff.
then again, you have to take the risk of at least spending the night in hold (before you get to court) which is a big pain. no matter how many times it happens. most cops have egos and will follow through with their bluff just to save face.

Actually, the cop has every right to make that claim really.

Someone's pain tolerance is all relative. Just because you can sit in a car that is playing at 150 DB's, doesn't mean any other average person can. Even if he was only hearing your music at 100 DBS, he could still scientifically argue that it was causing his ears some physical damage.

The above DJ reference about having a 10000 watt stereo is not at all applicable. First off any club running that much power would most likely have to file with the local power company, and thusly, need to file for their right to play a system that loud. When you are planning to open a club, you have to file through your city for that ability. Also, if you enter a club, you are then responsible for your own hearing and any damage that may occur, because you stepped into the club on your own accord.

Running loud systems in cars however, is much different. I have a system in my car, but I can't tell you how many times I've been woken up because people are blasting their systems at 2 am in the morning.

I don't care how much you payed for the system, or how many rights you think you have, you don't really have the right to violate other people's rights to silence and peace. If you were indeed rattling the cops mirrors, seats, dash, etc, etc its legit for him to make that plea, no matter how childish it sounds, your car was still causing him discomfort.

I had a friend next door who lost his system, because a neighbor said that he knocked priceless antiques off the shelf in the house and broke them when he drove down the street.

Put it this way, if you had a hard day at work, and wanted to just relax in your room, and the next door neighbors just started playing music so loud in their backyard that is rattled your walls, would't you be angry?

If the cop called this to court, you would most likely lose somehow, probably not assault, but hundreds of dollars in fines for noise pollution, disturbing the peace, etc, etc.

Its aggrevating I know, but you have to abide by laws you want abided by for you.

first off, i know alot about the law, although from state to state the laws change quite abit. the officer has the rtight to cite you for this, but it wouldn't stick. this is not assault and by charging you with assault the officer would most likely lose any credibility and therefore would most likely just be thrown out of court rather than incure any other fines. granted, this differs from judge to judge and mood to mood, lol, but it's definately not assault. the officer was just blowing smoke. it sounds like from your post you weren't even cited so it was an obvious tongue lashing and he just assumed you were ignorant to the law........
